What Service of Process Legislation is on the Table for 2017?

The laws that govern our country are constantly evolving, including the laws that regulate the service of process industry. In the first half of 2017 alone, a number of bills have been proposed across the country. Each bill, if passed, would have a unique impact on process servers and their communities.

In Florida, for example, rule 48.092 was recently created to provide instructions regarding service of process on a financial institution. According to the rule, financial institutions are permitted to set a sole central location or registered agent to receive service somewhere within the state. The chosen location is required to remain open Monday through Friday between 9:00 AM and 5:00 PM at a minimum. If financial institutions opt not to designate a location or person to receive service, any officer, director, or business agent at any location is obligated to accept service if approached by a process server. This is a very significant rule for the state of Florida, because it provides process servers with clear directives.

Meanwhile, HB 4294 in Michigan was referred to the Senate Judiciary Committee at the end of 201 and is currently awaiting decision. If passed, the bill would permit additional fees on top of service rates for any papers served in Michigan. For example, any writ of garnishment would cost $22 plus mileage, while every wrong address provided would be assigned a fee of $15.

Another bill in Arizona, SB 1018, aims to give certified process servers access to vehicle records. This bill was assigned to the Senate Rules Committee at the beginning of January, and no decision has been reached yet.
