Miami-Dade County Circuit Court Denies Rap Mogul’s Motion to Dismiss Lawsuit

You might think that a CEO sitting atop such a successful label wouldn’t have a problem paying employees, but according to a recent Florida lawsuit, that assumption would be incorrect.

Birdman’s old handyman Javier Nuno has sued Birdman for allegedly owing him upward of $300,000 in unpaid wages and overtime. However, in addition to refuting Nuno’s claim of being an employee on payroll, Birdman’s lawyer also alleged that the process server used by Nuno’s attorney served the papers in an inappropriate way. Birdman’s lawyer has attempted to use this as grounds for dismissing the lawsuit altogether.

The claim of insufficient service of process stemmed from the fact that the process server handed paperwork to a security guard at Birdman’s $15 million mansion on Palm Island, rather than to Birdman himself or one of his associates. Alan Sloven, Birdman’s attorney, said in court, “You can’t serve a security guard. You can’t serve the maid or the gardener. You have to serve someone who lives at the house, and I can promise you that the security guard doesn’t live in Bryan’s mansion.”

Despite this argument, the judge presiding over the case ruled that the process server broke no rules when he handed the court papers to Birdman’s security guard. Judge Rodney Smith refused to dismiss the case, which will soon go to court. In the meantime, Sloven is filing an appeal to the judge’s decision while claiming that Nuno was nothing but a “hanger-on” who lived on Birdman’s property but never served as an employee of any kind.
