How Social Media Is Being Used in Process Service

Social media has become entrenched in every part of our lives. It is not surprising that social media is now playing a role in the legal system. Private process servers use social media in a number of ways in the course of serving papers. Social media is also being used in new ways by the courts when it comes to service of process.

Social Media Investigations

Private process servers have to use a variety of tools to track down the people who need to be served. It is not unusual for someone who doesn’t want to be served to make themselves completely unavailable for service. While private process servers have tools such as skip tracing and private detectives to help them find people who are skipping out on a legal case, social media is sometimes an easier and less costly tool.

Depending on privacy settings in different social media platforms, a lot of information about an individual can be gleaned from their social media profiles. You can discover what city they are living in if they have moved, giving the process server a starting point for locating them. Social media can also tell them where the individual is working so that service can be given at their place of employment.

Social Media Service

Some courts are starting to actually allow service by social media. When an individual’s social media profile is public and they are certain to get the service of process, some courts are allowing service to be made in this way. It is an alternative method of service such as publication in a newspaper, but with  more of a reasonable chance that the individual will see the notice. While not all courts are allowing this, it is becoming more common across the nation.
